JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,452,328,324,307,379,427 and 380 of the Indian Penal Code. The accused persons came variously armed and started breaking and damaging the house of the informant and on protest being made, co accused Tarni Rai instigated to kill when petitioner gave sword blow on the head of the informant. The husband of the informant came to rescue then co accused Pawan Rai assaulted on the back of the informant by means of rod. It is further alleged that Shanti Devi assaulted the informant by lathi, other accused persons with fists and slaps and Kanti Devi snatched golden jewellery of the informant.

No.22265 of 2015 (2) dt.21-05-2015 2/2 It is submitted by the learned counsel for the petitioner that the injury of the inforfmant has been found to be of marginal size, there is no accusation of repeating the blow and there is counter version of the occurrence also. More over, the petitioner has also lodged case against the informant side being Chakai P.S. Case No. 79 of 2013 and Complaint Case No. 856C of 2013. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jamui in connection with Chakai P.S. Case No. 48 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
