2. The petitioner has preferred this application for grant of regular bail in connection with Chhatapur P.S. Case No. 156 of 2024 dated 18.05.2024 registered for the offences punishable u/ss 147, 341, 323, 307, 325, 354B, 379, 385, 504 and 506 of the Indian Penal Code.
3. As per the prosecution case, the informant alleged that while he was working at his door and his family members were harvesting crop, the accused persons variously armed came there and on the exhortation of Shivnandan Sharma, the co-accused persons caught hold of his son and the accused Shivanandan Sharma assaulted him with a farsa causing injury
Patna High Court CR. MISC. No.15043 of 2025(2) dt.24-03-2025 2/3 on his head. Thereafter, the petitioner gave iron rod blow on his right hand causing fracture injury. The allegation against the coaccused Domi Sharma is of outraging the modesty of his daughter-in-law while Vinod Sharma assaulted his wife with Dabia on her head. This led to the F.I.R.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The allegation against the petitioner is of assaulting the informant's son Mukesh Yadav on his right hand but as per the injury report no any injury was found on his right hand. Similarly situated co-accused has already been granted bail by the co-ordinate bench of this court vide order dated 10.12.2024 passed in Cr. Misc. No. 84022 of 2024. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 19.11.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the informant's son Mukesh Yadav sustained grievous injury.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of
Patna High Court CR. MISC. No.15043 of 2025(2) dt.24-03-2025 3/3 the like amount each to the satisfaction of learned Court concerned, Supaul in connection with Chhatapur P.S. Case No. 156 of 2024.
7. The application stands allowed.
