The sole petitioner, who is in custody in connection with Turkaulia P.S. Case No. 78 of 2018 registered for the offences under Sections 413, 414 of the Indian Penal Code, 1860, has prayed for grant of bail.
Learned counsel for the petitioner submits that petitioner is a motorcycle mechanic and while after doing some mechanical work this petitioner was on trial over the motorcycle, it was intercepted by Police and only on the ground that petitioner failed to produce 'Owner- Book' of the motorcycle he was apprehended on the plea that petitioner was moving on stolen motorcycle. He submits that it is not the case of
Patna High Court Cr.Misc. No.26818 of 2018(2) dt.04-05-2018 2/2 prosecution that motorcycle was stolen one and for theft of said motorcycle prior to the present case any F.I.R. was lodged. Be that as it may, considering the nature of accusation, let the petitioner - Mannu Kumar Mahto be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari / concerned court in connection with Turkaulia P.S. Case No. 78 of 2018.
