Petitioner seeks bail in connection with Yadopur P.S. Case No. 12 of 2020 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2018.

Near about 51.60 litre country made liquor was recovered which had been kept on the motorcycle. Petitioner was caught on the spot but admittedly, he is in jail custody since 22.01.2020 and the investigation against him has already been completed. Moreover, petitioner does not have any criminal antecedent.

No.13187 of 2020(2) dt.13-05-2020 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge (Excise), Gopalganj in connection with Yadopur P.S. Case No. 12 of 2020.

However, it is made clear that if the petitioner fails to make available sureties due to lockdown as well as due to prevailing situation, the concerned court shall release the petitioner provisionally on personal bond with condition that petitioner shall furnish the sureties when lockdown is over.
