The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code. The accusation is of kidnapping the minor daughter of the informant.
It is submitted by learned counsel for the petitioners that in 164 Cr.P.C. statement the victim has got her age recorded as 18 years when the court has assessed as such where she has stated that she was confined by the son of the petitioners, Suman, in a room and thereafter she was taken to
Patna High Court Cr.Misc. No.20715 of 2015 (02) dt.05-05-2015 2/2 Hazaribag where they got married. It is alleged against the petitioners that they threatened the victim and did not keep her as daughter-in-law.
Considering the fact that the victim admitted to have married with the son of the petitioners, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Bhagalpur in connection with Kahalgaon P.S. Case No. 428 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
