The petitioner seeks bail in connection with Kutumba P.S. Case No. 01 of 2024 instituted for the offence under Sections 379, 411 of the Indian Penal Code. 3.

As per prosecution case, 38 iron centering plates have been recovered from the under constructed house of the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 08.01.2024. Petitioner bears no criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's

Patna High Court CR. MISC. No.22264 of 2024(2) dt.01-04-2024 2/2 counsel that petitioner has been falsely implicated in the present case due to previous enmity. The petitioner has no concern with the alleged recovered articles and charge-sheet has already been submitted. It is further submitted that during preparation of seizure list, there is non-compliance of Section 100 of the Cr.P.C..

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, judicial custody of the petitioner, this Court is inclined to grant bail to the petitioner.

8. Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Aurangabad in connection with Kutumba P.S. Case No. 01 of 2024.
