ANJANA MISHRA ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 21.03.2017 and has been remanded in connection with the present case on 11.04.2017 registered for the offences punishable under Sections 20/21/22 of the NDPS Act.

In connection with the present case, learned counsel for the petitioner submits that the petitioner has admittedly fallen into bad ways and the quantity alleged to have been seized is only 50 grams which is not a commercial quantity. He further submits that the parents of the petitioner are willing to stand sureties to him for future good conduct and behavior.

In view of the aforementioned facts and

No.48593 of 2017 (2) dt.18-10-2017 2/2 circumstances and that the amount alleged to have been recovered from him is 50 grams, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge cum Special Judge, Muzaffarpur in connection with Town (NDPS) P.S. Case No. 182/2017 with the following conditions:-

(1) One of the bailors will be his father.

(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.

(3) The petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.

(4) The petitioner shall co-operate with the investigation, if not already concluded, and make himself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail. (Anjana Mishra, J) Saif/- U T
