It was communicated to us by the learned counsel for the petitioner that the appeal against the order of cancellation of license remained pending before the appellate authority for about ten years.

However, the learned counsel for the petitioner himself has very fairly brought on record the order passed by the appellate authority, dismissing the appeal of the petitioner for nonprosecution.

Patna High Court CWJC No.4385 of 2022 dt.07-07-2022 2/2 There is no reason for this Court to pass any further order as the license was cancelled ten years ago when the old control order was in currency. The vacant position must have been filled under the new Control Order, 2016.

Since the petitioner did not renew his license under the new Control Order (2016), no useful purpose would be served in making any further enquiry into the reasons for delay of disposal of appeal preferred by the petitioner.

The petition stands dismissed accordingly.
