The petitioners are apprehending their arrest in connection with Dhamdaha P.S. Case No. 131 of 2015 for the offences instituted under Sections 406, 420 and 120(B)/34 of the IPC.
The prosecution story, in brief, is that the petitioners and others entered into an agreement with the informant for transfer of land and the informant paid certain amount but ultimately the sale deed was not executed.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. For the same act, a Title Suit No. 198/2012 has also been filed. The matter relates to
Patna High Court Cr.Misc. No.15636 of 2016 (2) dt.03-05-2016 2/2 the civil dispute. The other co-accused have been granted anticipatory bail by this Court vide Cr. Misc. No. 12995/2016 and 16833/2016.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Dhamdaha P.S. Case No. 131/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Purnea, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
