The petitioner, already in custody, seeks bail in connection with Nasriganj (Rajpur) P.S.Case No. 04 of 2017 registered under Sections 147, 148, 149, 302, 307, 323, 325, 341 and 504 of the Indian penal Code.
Allegation in brief is that due to dispute over cutting trees, accused persons are said to have assaulted the informant's father and specific allegation of assault is against Ashok Ram, Deomuni Ram, Harmun Ram, Vinod Ram, Lalmuni Ram, Om Prakash Ram and specific overt act against the petitioner is of order giver.
Submission is that there is dispute with regard to cutting of trees and both sides are next door neighbours and there is no specific allegation of assault against the petitioner to the deceased who succumbed to injury after a week and petitioner
Patna High Court Cr.Misc. No.26181 of 2018(2) dt.03-05-2018 2/2 has no criminal antecedent.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Mohan Ram, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Mr. Lal Bihari Paswan, J.M, 1st Class at Bikaramganj, Rohtas in connection with Nasriganj (Rajpur) P.S.
