The petitioner apprehends her arrest in Janta Bazar P.S. Case No.112 of 2016 registered under Section 47 of Bihar Prohibition and Excise Act.
According to the allegation made in the F.I.R., it appears that the house of the petitioner was searched and about one liter of country made liquor made by Mahua was recovered. The learned counsel for the petitioner submits that the petitioner is a lady. Her husband and other family members are also living in the same house. For the recovery of one liter of country made liquor made by Mahua, the petitioner cannot be held responsible.
Taking into consideration the fact aforesaid and the
Patna High Court CR. MISC. No.17750 of 2019(2) dt.27-03-2019 2/2 nature of allegation made against the petitioner and the fact that petitioner is a lady, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Saran at Chapra in connection with Janta Bazar P.S. Case No.112 of 2016, corresponding to G.R. No.6384 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
