2. The petitioner has approached this Court seeking a direction upon the respondents to pay post retiral benefits under different heads viz. gratuity in full, earned leave, arrears as per 7th pay scale, dues under ACP/MACP, group insurance and other benefits.

3. A counter affidavit has been filed on behalf of the respondent-University on 11.10.2023 with an averment that the gratuity was calculated and 75% amount has already been paid.

It was further stated that the amount under the head of leave encashment will also be paid subject to the availability of grant from the State Government, for which the requisition has been sent.

4. Learned Advocate for the University further submits that so far the payment of consequential benefits of ACP/MACP and salary difference in 7th pay scale are concerned, no bill claims are pending at the University level. The group insurance amount has already been paid to the petitioner.

5. Mr. Om Prakash, learned Advocate for the University on instruction further submits that during the interregnum period, now all the outstanding remaining dues have been paid.

6. On the last occasion, when the matter was taken up, time was granted to the learned Advocate for the petitioner to file response to the counter affidavit, but the same has not been done.

7. Be that as it may, considering the submissions advanced by learned Advocate for the University, the present writ petition stands closed.

8. However, the present order will not come in the

Patna High Court CWJC No.5288 of 2023 dt.23-06-2026 3/3 way of the petitioner, if still there is any outstanding dues, he would be at liberty to file an appropriate application before the Registrar of the University, who shall look into the matter and ensure the payment, if found admissible.
