JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 406 of the Indian Penal Code.

It is alleged that the petitioner made to disappear the milk van of the informant which was handed over to him for transporting of milk.

It is submitted by learned counsel for the petitioner that the present case has been filed since the petitioner supplied milk to the informant worth Rs. nine lacs and when the demand of payment was made then the present case was lodged. The petitioner also filed Informatory Petition no. 1242 of 2012 on 25.10.2012 when the FIR was also lodged on the same day. Considering the nature of accusation, let the above

Case No. 314 of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C.
