JUSTICE RAKESH KUMAR ORAL ORDER 07-05-2018 Heard learned counsel for the petitioner and Sri Pramod Kumar Pandey, learned Additional Public Prosecutor. The sole petitioner, who is in custody in connection with Gardanibagh P.S. Case No. 44 of 2018, registered for the offences under Sections 417 & 420 of the Indian Penal Code, 1860 , has prayed for grant of bail.

At the very outset, learned counsel for the petitioner has drawn my attention to the statement made in paragraph no. 3 of the petition to show that petitioner is having clean antecedent. It was further submitted that petitioner is in custody only on an accusation that his thumb impression was not tallying with earlier thumb impression which was given in the written test for Constable recruitment.

Considering the nature of accusation and clean

Patna High Court Cr.Misc. No.27300 of 2018(2) dt.07-05-2018 2/2 antecedent of the petitioner, let the petitioner Sujit Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Sub Judge -cum- A.C.J.M., XIV, Patna / concerned court in connection with Gardanibagh P.S. Case No. 44 of 2018.
