2. The accused/petitioner is named in the F.I.R. and is in custody since 10.04.2023.

3. This is the second successive bail petition of the petitioner as his first and earlier bail petition was rejected by one of the learned co-ordinate Bench of this Court through Cr. Misc. No. 56331 of 2023 dated 08.01.2024 considering the available merits.

4. Mrs. Archana Sinha, learned senior counsel appearing on behalf of the petitioner submitted that while disposing the first bail petition, this Court directed to learned trial court to expedite the trial and conclude the same as soon as possible, despite of

Patna High Court CR. MISC. No.19569 of 2025(5) dt.15-09-2025 2/3 same till now only one prosecution witness was examined in this matter, whereas this petitioner is in custody since 10.04.2023 i.e. almost about two and half years.

Mrs. Sinha submitted that the present successive petition is on the sole ground of custody as trial of this case is not likely to conclude in near future and same appears in violation of article 21 of the Constitution of India of petitioner qua his right of speedy trial. In support of her submission, Mrs. Sinha relied upon the legal report of Hon'ble Supreme Court as available through Hussainara Khatoon and Others Vs. Home Secretary, State of Bihar, reported in 1980(1)SCC 98.

6. Mr. Vijay Anand, learned counsel appearing for Union of India could not disputed the custody period, as submitted aforesaid.

In view of aforesaid facts and circumstances as petitioner remains in custody since 10.04.2023 i.e. about two and half years, where only one charge sheet witness was examined by the learned trial court, which is sufficient to suggest that trial of this case is not likely to conclude in near future, accordingly, petitioner above named, is directed to be released on bail in connection with Economic Offence P.S. Case No. 04/2019, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with

Patna High Court CR. MISC. No.19569 of 2025(5) dt.15-09-2025 3/3 two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna/concerned Court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480(3) of BNSS.
