The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 342, 323, 498A, 506, 504, 379, 34 of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.
It is a case of cruelty and harassment with the informant due to non-fulfillment of dowry demand after that
Patna High Court CR. MISC. No.16974 of 2023(2) dt.29-04-2023 2/3 this case has been lodged against the petitioner along with co-accused persons.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is the husband of the informant due to which he has falsely been implicated in this case. The allegation against the petitioner is only pouring hot water due to which leg of the informant burnt but the same is not a vital part. The occurrence took place on 1.9.2022 but the FIR has been lodged on 24.9.2022 after delay of 22 days. It is further submitted the petitioner has got no criminal antecedent moreover, he is languishing in judicial custody since 30.11.2022.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jehanabad Mahila P.S. Case No. 32 of 2022 on furnishing bail bond of
Patna High Court CR. MISC. No.16974 of 2023(2) dt.29-04-2023 3/3 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jehanabad.
