====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-04-2025 Heard learned counsel for the petitioner and the State.

2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 379, 511 and 34 of the IPC and section 136 of the Indian Electricity Act.

3. As per the prosecution case, four accused persons tried to open the transformer for committing theft of its oil. However, one of them was caught by villagers who disclosed names of his three associates including the petitioner who managed to flee away from the spot. He also confessed that petitioner had also brought his tractor for transporting transformer oil.

4. Learned counsel appearing for the petitioner submits that no incriminating article has been recovered from the conscious possession of the petitioner. Petitioner's name has

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Birpur, Supaul in Pratapganj Police Station Case No. 25/2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
