Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 308, 323, 324, 325, 341, 447, 504, 506 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act.
It is alleged that accused persons variously armed came and started tilling the land of the informant and on protest being made the accused persons abused the informant by calling caste name and made assault. It is submitted by learned counsel for the petitioners that accusation is omnibus and general against the petitioners whereas the other co-accused who have specific accusation of assault have been granted regular bail.
Patna High Court Cr.Misc. No.20957 of 2015 (2) dt.25-06-2015 2/2 This Court sees no reason for learned Court below not to consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Matiyaria P.S. Case No. 50 of 2014, pending in the Court of learned Chief Judicial Magistrate, Bettiah.
With the observations above, the application stands disposed off.
