ANJANA MISHRA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner, being the truck owner, is apprehending his arrest in connection with Sikarhatta PS case no. 13/2016 for allegedly having committed the offence under Sections 411/120(B) of the Indian Penal Code and Section 7 of the Essential Commodities Act.
Learned counsel for the petitioner submits that the petitioner had given his truck to the transporting agency bearing truck no. WB 25B-3825 for transportation of rice. The allegation is that the aforementioned truck no. was found to have been parked near one rice mill with the loaded rice and and the said rice
Patna High Court Cr.Misc. No.17904 of 2016 (3) dt.03-05-2016 2/2 would have to be unloaded thereon. Learned counsel for the petitioner submits that so far as petitioner is concerned, he is not at all concerned with any transportation rather he is only the truck owner having let out his vehicle for the said purpose. Considering aforesaid facts and circumstances let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Ara in connection with Sikarhatta PS case no. 13/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
