BADAR ORAL ORDER 20-12-2021 The applicant/accused in Crime No. 73 of 2019 registered with Chandan (Anandpur) Police Station for the offences punishable under sections 452/354B of the Indian Penal Code as well as under sections 11 and 12 of the Pocso Act, by this application is seeking his release on bail during pendency of the trial.

The learned counsel for the applicant argued that the applicant is behind the Bars for a period of more than 2 years and 3 months. He submits that the offence is punishable with imprisonment for three years. Therefore, the applicant is entitled to bail.

Learned APP opposed the application.

Victim female child has reported to the police that when she was sleeping in the house along with her parents, the applicant entered in her house and attempted to embarrass her.

The investigation of the crime in question which was reported on 4.5.2019 is already over. The applicant is behind the Bars for a period of about 2 years and 3 months. He is not having any criminal antecedent.

The application is allowed.

The applicant/accused in Crime No. 73 of 2019 registered with Chandan (Anandpur) Police Station is directed to be released on bail on executing P.R. Bond of Rs. 10,000/- (Ten Thousand) on furnishing sureties of the like amount to the satisfaction of the trial court with the following conditions:- (I) The applicant/accused should not extend any threat, promise of inducement to the persons acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer.

(II) The applicant/accused should not repeat the

(III) The applicant to remove all office objections forthwith and the Registry to issue certified copy of this order only after removal of office objections by the applicant/accused.
