The petitioner apprehends his arrest in Deep Nagar P.S. Case No. 14/2016, registered for the offence punishable under Sections 323, 325, 337, 307, 448, 504, 34 of the Indian Penal Code.

The informant alleged that Dhiraj Umar assaulted his son Ravi Shankar with Khanti on his head, thereafter, the petitioner and his mother also assaulted his son with lathi and bricks. Petitioner and his mother are alleged to have assaulted father-in-law and husband of the informant.

It is submitted that Dhiraj Kumar is alleged to have assaulted the son of the informant with Khanti on his head.

Patna High Court Cr.Misc. No.15117 of 2016 (3) dt.30-06-2016 2/2 Petitioner is alleged to have assaulted father-in-law and husband of the informant. Father-in-law got two injuries simple in nature. Learned A.P.P. however vehemently opposed the prayer for anticipatory bail.

It appears that Dhiraj Kumar assaulted Ravi Shankar who got as many as five injuries out of which three injuries are grievous in nature.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

If the petitioner surrender in the court below, learned court below shall consider his prayer for regular bail taking into consideration that Dhiraj Kumar is alleged to have assaulted Ravi Shankar with Khanti on his head has already been granted regular bail and dispose of the same preferably on the same day.
