This application is for grant of regular bail in connection with Bakhtiyarpur (Balwahat) P.S.Case No.327 of 2016, registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Allegation against the petitioner, as per FIR, is that he surrounded the deceased and thereafter the other co-accused have stabbed him.
Submission of the learned counsel for the petitioner is that there was no intention to kill him. There was dispute with respect to loading the passengers and the occurrence has taken place. The petitioner is in custody for about four months. Heard learned A.P.P. and the learned counsel for the
Patna High Court Cr.Misc. No.38796 of 2017 (3) dt.06-09-2017 2/2 informant. They have opposed the prayer for bail. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed for commitment of the case and once the charge is framed, the petitioner may renew his prayer for bail.
With the aforesaid observation, this application is dismissed.
