JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 436/34 of the Indian Penal Code.
The accusation is of putting the shop of the informant on fire.
It is submitted by learned counsel for the petitioner that the accusation of carrying petrol in a gallon is against Bharat Rai and Binda Rai. The petitioner was simply standing at the place of occurrence and due to land dispute, the accusation has been levelled.
It appears that earlier also, the informant filed a case under Section 307 of the IPC being Sitamarhi P.S. Case No. 147 of 2013 in which the petitioner was made an accused where the
Patna High Court Cr.Misc. No.21972 of 2015 (2) dt.24-06-2015 2/2 accusation was of throwing the acid.
The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Sitamarhi P.S. Case No. 252 of 2014 pending in the court of learned CJM, Sitamarhi. Accordingly, the application is disposed of.
