The petitioner seeks bail in connection with Sadar P.S. Case No. 461 of 2019 (G.R. No. 3111 of 2019), dated 02.09.2019, instituted for the offence under Section 395 of the Indian Penal Code.

The petitioner is not named in the F.I.R. His name has transpired during the course of investigation on the confession of co-accused/Fakir Mohammad, who has been granted bail by a Bench of this Court. Nothing incriminating appears to have been recovered from the house of the

Patna High Court CR. MISC. No.16637 of 2020(2) dt.03-06-2020 2/2 petitioner except one mobile phone which belongs to him. The petitioner has also not been put on Test Identification Parade.

The petitioner is stated to be in custody since 19.11.2019.

Considering the facts aforestated, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Sadar P.S. Case No. 461 of 2019 (G.R. No. 3111 of 2019).

The application stands allowed.
