07-05-2018 Heard Sri Bakshi S.R.P. Sinha, learned senior counsel assisted by Sri Lokesh Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Barauli P.S. Case No. 62 of 2018 registered for offence under Sections 21,22 of the Narcotic Drugs and Psychotropic Substances Act, 1985, has prayed for grant of bail.
Learned senior counsel for the petitioner, at the very outset, has drawn my attention to statement made in paragraph 3 of the petition to show that petitioner is having clean antecedent. He further submits that petitioner has falsely been implicated on an accusation of recovery of 1 Kg. of Ganja. He submits that seizure list was not prepared in accordance to law and seized
Patna High Court Cr.Misc. No.26945 of 2018(2) dt.07-05-2018 2/2 Ganja was wrapped in white paper and total weight with packing paper was one kg. According to him, the seized Ganja was of smaller quantity.
Considering the nature of accusation and clean antecedent of the petitioner, let the petitioner namely Arbind Kumar Singh @ Arbind Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, Gopalganj in connection with Barauli P.S. Case No. 62 of 2018, corresponding to Trial No. 09 of 2018.
