The petitioner seeks bail in a case registered for offences under Section 30 (a), 34 and 38 of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 285 pouches each containing 200 ml of country-made liquor were allegedly recovered from the motorcycle which was being boarded by two persons including the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 11.07.2017. Considering the facts and the circumstances of the

No.40285 of 2017(2) dt.25-08-2017 2/2 case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Rohtas at Sasaram in connection with Sasaram Town P.S. Case No. 830 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
