Petitioner, already in custody, seeks bail in connection with Gurua PS Case No.44 of 2017, registered under Sections 147, 149, 341, 323, 324, 302, 337, 338, 504 and 506 of the Indian Penal Code.

Allegation in brief is that on account of dispute regarding tapping toddy, first of all five persons are said to have assaulted the informant's father with brick and lathi and it is also alleged that the petitioner also assaulted with brick over the head of his father causing his death.

Learned counsel for the petitioner submits that at the first instance, five persons are said to have assaulted and later on it is said that petitioner gave a brick blow but two injuries were

No.26674 of 2018(2) dt.04-05-2018 2/2 found on the forehead and on injury on cheek, moreover the petitioner is a IVth grade employee in the Block Agriculture Office, Sherghati, Gaya, he was in his office at the relevant point of time and the petitioner has no criminal antecedent. Having considered the aforesaid fact, petitioner Rajbali Choudhary is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sherghati at Gaya in connection with Gurua PS Case No.44 of 2017.
