The appellant seeks anticipatory bail in connection with Amarpur P.S.Case No. 65 of 2017, registered for offences punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code and under Section 3(2) (V) SC/ST Act. The allegation against the appellant along with other co-accused persons is of assaulting the husband of the informant. Submission of the learned counsel for the appellant is that he has been made accused only on the basis of suspicion. Except suspicion, there is nothing against him Heard learned Special P.P. also has opposed the prayer on the ground of maintainability.

Having heard both sides and in view of the facts as

Patna High Court CR. APP (SJ) No.2206 of 2017 (3) dt.31-08-2017 2/2 stated above, let appellant surrender before the Special Court and make prayer for regular bail and if any such application is filed, the Special Court after considering the submission of learned counsel for the appellant that no specific overt act has been attributed to him and also considering the other materials available on record, shall pass an appropriate order, preferably on the same day, without being prejudiced by the order of this Court.
