The petitioner seeks regular bail in connection with Sessions Trial No. 106 of 2022 arising out of Dinara P.S. Case No. 233 of 2021 registered for the offence punishable under Sections 302, 304 (B) and 201 / 34 of the Indian Penal Code. Prosecution case as emerging from the FIR is that the petitioner, who is husband of the victim and his family members tortured the victim for fulfillment of dowry demand and committed murder of daughter of informant and thereafter they burnt her dead body.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.20288 of 2023(2) dt.17-05-2023 2/3 petitioner has falsely been implicated in this case. The marriage of petitioner with victim has taken place 10 years ago. Accordingly, dowry demand case is not applicable in this case. Further, it is stated that there is no eye-witness in this case. Petitioner has no criminal antecedent and he was not present at the time of occurrence. This case is fixed for framing of charge before learned Court below. Petitioner is languishing in jail custody since 29.11.2021.

Learned APP appearing for the State has opposed the prayer for regular bail of the petitioners.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - V, Rohtas at Sasaram in connection with Dinara P.S. Case No. 233 of 2021.

1. Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court.

2. Petitioner shall cooperate the Court below in framing the charge of this case.

3. In case of absence on two consecutive dates without sufficient reason or if the petitioner misuse the liberty or violate any of the conditions imposed upon him his bail bond will be liable to be cancelled by the Court concerned. (Sunil Dutta Mishra, J) saurabhkr/- U T
