2. The petitioner has preferred this application for grant of regular bail in connection with Ranitalab P.S. Case No. 89/2024 dated 18.03.2024 registered for the offence punishable u/s 341, 307, 376, 498A, 504 and 506 read with Section 34 of the Indian Penal Code and Section 3 and 4 of the D.P. Act

3. As per the prosecution case, the informant's daughter Annu Kumari was married with the petitioner, but after marriage there were complaints from her matrimonial house that she did not work properly, while the petitioner started demanding motorcycle. On 17-03-2024, the informant's

No.14933 of 2025(2) dt.28-03-2025 2/3 daughter called the informant and told him that she would die and when he asked the reason, she told that the petitioner had inserted his hand in her anus and tore it. On 18-03-2024 the informant reached at her matrimonial house, Thereafter, the petitioner and other-in-laws abused him and seeing the serious condition of his daughter, he took her daughter to concerned P.S. and then to P.H.C., Bikram for treatment, from where she was refereed to P.M.C.H, Patna.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner who is husband of the informant's daughter. The petitioner neither demanded any dowry nor tortured the informant's daughter. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 19.03.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the petitioner is husband of the informant's daughter. On perusal of the prescription issued by P.H.C., Bikram shows that there was swelling/bleeding from anus opened/rupture of the victim. She was treated at P.M.C.H. and treatment papers of the P.M.C.H.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Danapur, Patna in connection with Ranitalab P.S. Case No. 89/2024.

7. The application stands allowed.
