2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 316(2), 318(4), 338, 336(3) and 61(2) of the B.N.S..

3. As per prosecution case, it is alleged that these petitioners, in conspiracy with other accused persons, fraudulently usurped the land of informant and his wife by preparing forged sale deed through misrepresentation and fabricated documents. It is further alleged that petitioners facilitated in execution of the sale deed on the basis of forged and fabricated documents by acting as purchasers, executors, witnesses and identifiers.

4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. Petitioner Nos. 1 to 6 are bona fide purchasers, Petitioner No. 7 is identifier and Petitioner No. 8 is witness to the sale deed. Petitioners got executed the sale deed after payment of due consideration money and following the due procedure and the land in question has already been mutated in the name of Petitioner Nos. 1 to 6. Moreover, the dispute is with regard to sale and purchase of land which is purely civil in nature and for which informant has got

5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioners.

6. Considering the facts and circumstances of the case, nature of accusation and clean antecedents of the petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, Patna in connection with Gopalpur P.S. Case No. 197 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S..
