The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 34 of the Indian Penal Code.
As per the prosecution case, on the brother of the informant not returning, search started but he was not to be found. Subsequently his dead body was found at the gate of the campus of one Guddu Thakur. People were talking that the three accused persons including the petitioner herein as also the shopkeeper have beaten him to death.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. There is no eye witness of the occurrence. The manner of occurrence is other than what has been narrated in the FIR and the same
Patna High Court CR. MISC. No.26223 of 2021(3) dt.23-12-2021 2/2 would be evident from the FIR (Annexure-2) lodged by Vikash Kumar Gupta. The petitioner is in custody since 21.12.2020 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, chargesheet having been submitted and the petitioner having remained in custody for 1 year, the petitioner is directed to be enlarged on bail in connection with Chhatauni P.S. Case no. 487 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran.
