JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 414/34 of the Indian Penal Code.

Prosecution case is that on getting secret information that the petitioner and co-accused Amresh Sharma have kept some theft articles with them, the informant laid a raid on 14.01.2016 at 10:45 AM at village Tuturkhi when seeing the police the accused persons managed to flee away.

It is submitted by learned counsel for the petitioner that recovery has not been made from the possession of the petitioner. Moreover, the actual recovery has been made from the co-accused Amresh Sharma. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.16602 of 2016 (2) dt.18-04-2016 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection with Konch P.S. Case No.10/2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
