The petitioners are seeking anticipatory bail in connection with Koilwar P.S. Case No. 500 of 2018 registered under Sections 147, 148, 149, 323, 325, 504, 506, 354A, 307, 379 of the Indian Penal Code.
The case of the prosecution is that on 28.12.2018 the informant submitted a written application to the SHO of Koilwar Police Station alleging that she heard some sound when she was inside her house. She saw the accused persons including the petitioners taking away her Bansballi then she protested and assaulted by the accused persons by means of Lathi Danda etc. As a result of which she became injured. On hearing hulla her son and
Patna High Court CR. MISC. No.16674 of 2019(2) dt.26-03-2019 2/2 daughter came to rescue her, they were also assaulted. On Hulla, nearby people came out and brought the injured person including the informant to the hospital for treatment.
Learned counsel for the petitioners submits that there are general and omnibus allegation against the petitioners and petitioners have no criminal antecedent as stated in paragraph 3 of the application.
Learned A.P.P. does not dispute this position. Considering the facts and circumstances of the case wherein there is no specific allegation against the petitioners, in the event of their arrest/surrender before the court below within a period of four weeks, let the above-named petitioners be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Koilwar P.S. Case No. 500/2018, subject to condition prescribed under Section 438(2) of the Code of Criminal Procedure. (Rajeev Ranjan Prasad, J) Rajeev/- U T
