JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and State The petitioner is an accused in Parwalpur P.S. Case No. 85 of 2016 for the offences under Sections 341, 323, 307, 279 and 504/34 of the Indian Penal Code.
The petitioner and the informant are Gotia. There is case and counter case.
Counsel for the petitioner has placed reliance on Annexure-1 to submit that the injury is simple in nature. Having regard to the fact that the petitioner and the informant are Gotia and there is case and counter case, the Court is inclined to grant bail to the petitioner in order to encourage restoration of better relationship between the petitioner and the informant, who are said to be the Gotia. Patna High Court Cr.Misc. No.38145 of 2017 (3) dt.19-08-2017 2/2 named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Hilsa, Nalanda or the successor Court in connection with Parwalpur P.S. Case No. 85 of 2016, subject to the condition that the petitioner will extend full cooperation in the conclusion of the trial and will not, in any manner, tamper with the evidence or influence the witnesses. The Court hopes and trusts that the counsel appearing on behalf of the petitioner and the informant will advise their respective clients to enter into amicable settlement of their dispute, as they are Gotia and belong to the same branch.
