JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 09-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Bihiya P.S.Case No. 344 of 2020 for the offences punishable under Sections 420, 467, 468, 406, 504 and 506 of the Indian Penal Code.
As per allegation in the F.I.R, Petitioner has taken loan amount to the informant with assurance to return within five to six months but he did not return.
Learned counsel for the petitioner submits that petitioner is falsely implicated in this case. Informant and petitioner are close relatives. It is submitted that this case comes within the purview of 138 of the Negotiable Instruments Act. Learned Additional Public Prosecutor opposed the
Patna High Court CR. MISC. No.27333 of 2021(3) dt.09-03-2022 2/2 bail prayer of the petitioner.
Considering the facts and circumstance of the case as well as submission of the parties, let the petitioner in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 5th Bhojpur at Ara in connection with Bihiya P.S Case No. 344 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U
