2. Earlier anticipatory bail of the petitioner was rejected by a Co-ordinate Bench vide order dated 27.09.2024 passed in Cr. Misc. No. 50177 of 2024.
3. The petitioner seeks bail in in connection with Sitamarhi P.S. Case No. 261 of 2020, instituted for the offences punishable under Sections 304(B) and 34 of the Indian Penal Code.
4. The prosecution case, in short, is that there is allegation against the petitioner along with other co-accused persons that they have killed informant's sister for nonfulfillment of dowry whose marriage was solemnized with the petitioner.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. Learned counsel for the petitioner also submits that the petitioner is husband of the deceased and there was no any demand of dowry made by the petitioner. It is next submitted that the petitioner himself informed the informant about the missing of his wife. It is further submitted that on perusal of post-mortem report it transpires that there is no sign of any external injury. The petitioner is in custody since 18.10.2024 and has got no criminal antecedent.
6. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.
7. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
8. Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sitamarhi P.S. Case No. 261 of 2020, subject to the following conditions:

(II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.
