The petitioner is in custody since 06.12.2017 in connection with Parbatta P.S. Case No. 430 of 2017 for the offence registered under Sections 25(1-A), 25 (1-AA, 25 (1-B) a, 25 (1-B) e, 26 and 35 of the Arms Act.
Learned counsel for the petitioner submits that though it is alleged that the recovery of the arms were from the premises of the petitioner, the shop in question has been leased to one Niranjan Kumar and, therefore, the same cannot be said to have been seized from his conscious possession Considering the aforesaid facts and circumstances of the case and the period of custody and that the petitioner has been accused in one another case, in which, he has been acquitted, let
Patna High Court Cr.Misc. No.26762 of 2018 (2) dt.17-05-2018 the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Khagaria in connection with Parbatta P.S. Case No. 430 of 2017.
