====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 06-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Mansi P.S. Case No. 134 of 2020 lodged under Sections 341, 323, 307, 326, 379 and 34 of the Indian Penal Code. As per the allegation made in the F.I.R., there is a general allegation of threat upon three known and two unknown accused persons that they have snatched gold chain and Rs.5,500/- from the jeans pant of informant's son whereas the specific allegation against Sintu Kumar is to make the firing in
Patna High Court CR. MISC. No.15303 of 2022(2) dt.06-07-2022 2/3 air. Petitioner is in custody since 02.12.2021. Learned counsel for the petitioner submits that coaccused Rana Kumar and Sintu Kumar has been granted bail by a co-ordinate Bench of this Court (vide annexure 2 and 3). But there is a peculiar circumstances in which there are in total 18 criminal cases against the petitioner but in 10 cases he was acquitted and presently in 8 cases he is on bail. Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case that with a view to maintain the parity, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Learned Chief Judicial Magistrate, Khagaria in connection with Mansi P.S. Case No. 134 of 2020, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
The petitioner is directed to appear on each and every date before the Trial Court, in case of non-appearance for two consecutive dates, shall resulted into cancellation of his bail bond. If he shall involve in such type of activities again, the prosecution shall be at liberty to move for cancellation of his
