JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 19-04-2025 Heard Mr. Anish Kumar, learned counsel for the petitioner and Mr. Umeshanand Pandit, learned APP for the State. 2.The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with N.H. Bangra P.S. Case No. 114 of 2024 instituted for the offence under Sections 126(2), 115(2), 109, 303(2), 304(2), 352, 351(2), 74, 308(5), 3(5) of B.N.S. and Section 27 of the Arms Act.

3. The case of the prosecution is that the petitioner was having some business transaction with the informant. It is alleged that the petitioner along with others have threatened the informant. The specific allegation against the petitioner is that he has taken away Rs. 1 lakh from the purse of the informant and also the golden chain.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no

Patna High Court CR. MISC. No.14610 of 2025(2) dt.19-04-2025 2/2 offence. It has further been submitted that due to some business transaction, this petitioner has been framed in this case. It has also been submitted that co-accused persons, namely, Kundan Kumar and Tarun Kumar have been granted anticipatory bail by learned Co-ordinate Bench of this Court vide order dated 20.03.2025 in Cr. Misc. No. 5764 of 2025. The case of this petitioner stands on similar footing.

5. Learned APP appearing for the State has opposed the prayer of bail of the petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with N.H. Bangra P.S. Case No.114 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.F.C., Civil Court, Samastipur, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
