The petitioner seeks bail in Marhaura P. S. Case No. 136 of 2017 instituted for the offence under Section(s) 302, 307, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for petitioner submits that petitioner is not named in the written report.

In the written report, specific allegation of making indiscriminate firing with sophisticated arms on the informant's car after forming an unlawful assembly is against co -accused Sanjay Singh @ Tunna Thakur, Santosh Kumar Singh @Lalu Thakur, Lal Mohan Singh, Jitendra Kumar Singh, Chandan

Patna High Court CR. MISC. No.18866 of 2019(2) dt.28-03-2019 2/2 Kumar and Rajesh Kumar Singh and 3-4 other unknown persons.

Learned counsel for the petitioner submits that the name of this petitioner has come during investigation merely on suspicion. The other co-accused of this case has already been granted bail by co-ordinate Bench of this Court vide order dated 11.1.2019 passed in Cr. Misc. no. 64478 of 2018. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the J.M. 1st Class, Saran at Chapra, in connection with Marhaura P. S. Case No. 136 of 2017 subject to the condition that both the bailors shall be the close relative of the petitioner.
