This is an application for bail in connection with Sanhaula P.S. Case No. 55 of 2017 registered for the offences punishable under Sections 363, 366A, 120B of the Indian Penal Code and Section 4 of POCSO Act.

Allegation against the petitioner is of kidnapping minor daughter of informant and the victim girl has supported the prosecution case in her statement under Section 164 Cr.P.C. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case as except allegation of kidnapping there is nothing against him and he is in custody for more than four months.

Heard learned APP also, who has opposed the prayer for

Patna High Court Cr.Misc. No.39900 of 2017 (3) dt.18-10-2017 2/2 bail in view of allegation.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage.

However, once charge has been framed in this case, learned court below will release the petitioner on bail to its own satisfaction.

With the above observation, this application is disposed of.
