04-05-2018 Heard Sri Vishwajit Singh, learned counsel assisted by Sri Kundan Kumar Singh, learned counsel for the petitioner and Sri Madhuranand Jha, learned Addl. Public Prosecutor. The sole petitioner, who is in custody only since 04-01-2018 in connection with Forbisganj P.S. Case No. 07 of 2018 registered for offence under Sections 413, 414, 34 of the Indian Penal Code, has prayed for grant of bail. Learned counsel for the petitioner submits that petitioner, unaware of any theft of motorcycle, was moving as pillion rider on a motorcycle, which was intercepted by the police and police, on an accusation as if motorcycle was stolen, arrested six accused persons, including the petitioner. He submits that petitioner was earlier never involved in such type

Considering the nature of accusation and period of custody, let the petitioner, namely, Anuj Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbisganj P.S. Case No. 7 of 2018.
