The petitioner is apprehending his arrest in connection with Akilpur P.S. Case No. 52 of 2019 for the offence registered under Sections 341, 323, 307 and 34 of the Indian Penal Code.
Allegation against the petitioner is that he assaulted the informant by lathi and danda.
Learned counsel for the petitioner submits that the petitioner is aged about 67 years and he has falsely been implicated in connection with the present case. Learned counsel for the petitioner submits that the injury sustained by the informant is simple in nature. It is further submitted that similarly situated co-accused persons have been granted
Patna High Court CR. MISC. No.16409 of 2020(2) dt.15-11-2021 2/2 anticipatory bail by the lower court. It is further submitted that the informant and the petitioner are own patidar and there is land dispute for partition. It is further submitted that the petitioner has no criminal antecedent.
Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, XIV, Saran at Chapra in connection with Akilpur P.S. Case No. 52 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr. P.C (Sunil Kumar Panwar, J) Jagdish/- U T
