JUSTICE ARUN KUMAR ORAL ORDER 07-05-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Ujiarpur P.S.Case No. 27 of 2018 registered under Section 394 of the Indian penal Code and 27 of the Arms Act.
Allegation in brief is that 46 mobiles of the informant was robbed by some unknown miscreants on the point of pistol and during investigation, 15 mobile sets were recovered from the shop of the petitioners said to be looted mobiles. Submission is that petitioner is a shopkeeper and only IMEI numbers of three looted mobiles matched with the recovered mobiles from the possession of the petitioner and he had no knowledge whether mobiles are looted one and he is in custody since 27.02.2018 even petitioner has not been put on TIP.
Patna High Court Cr.Misc. No.28232 of 2018(2) dt.07-05-2018 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely , Md. Afjal, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned SDJM, Dalsingh Sarai, Samastipur in connection with Ujiarpur P.S. Case No. 27 of 2018.
