The petitioner apprehends his arrest in Complaint Case No.209 of 2018 registered under Section 498(A) of the Indian Penal Code.

The complainant made allegation of demand of dowry and torture against the petitioner but learned counsel for the petitioner submits that the petitioner filed Matrimonial Case No.87 of 2017 for declaring the marriage void. No marriage of the petitioner was ever solemnized with the complainant. Thereafter the complainant filed this complaint case in the year 2018.

Having considered the facts that prior to institution of

Patna High Court CR. MISC. No.15130 of 2019(2) dt.12-03-2019 2/2 this case by the complainant, her husband had earlier filed matrimonial case for declaring the marriage void, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Complaint Case No.209 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
