Petitioner, already in custody, seeks bail in connection with Paharpur P.S. Case No.180 of 2017, registered under Sections 461, 379 and 354 of the Indian Penal Code. Allegation is that when the informant was sleeping after taking meal on her bed, she woke up after hearing the sound of breaking open the box. There is also allegation of pulling of sari of the informant.

Learned counsel for the petitioner submits that no theft has been committed and the petitioner is in custody since 01.07.2017 and he has got no criminal antecedent. Having considered the said facts and circumstances,

Patna High Court Cr.Misc. No.43466 of 2017 (2) dt.20-09-2017 2 /2 petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari, East Champaran in connection with Paharpur P.S. Case No.180 of 2017.
