Petitioner seeks bail in Special Case No.915 of 2018 arising out of Kursakanta (Sonamani Godam) P.S. Case No.175 of 2018 instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioner submits that there is no recovery from possession of the petitioner.

It is alleged that police found some persons carrying jute bag. On seeing the policy party, they threw the bag. The police chased and arrested one person, who disclosed his name as Kundan Kumar Baitha. The police recovered total 1102 bottles of Nepali wine each of 300 ML. Name of this petitioner

Patna High Court CR. MISC. No.14134 of 2019(2) dt.07-03-2019 2/2 has been disclosed by aforesaid Kundan Kumar Baitha. Petitioner is in custody since 25.01.2019 having clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge cum Special Judge, Araria, in connection with Special Case No.915 of 2018 arising out of Kursakanta (Sonamani Godam) P.S.
