The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147/148/149/341/323/337/307/506 of the Indian Penal Code, Section 27 of the Arms Act and Section 37(b)(c) of the Bihar Prohibition and Excise Act, 2016.

Submission is that cousin sister of the petitioners had lodged Digha P.S. Case No.582 of 2018 against the informant of this case and others alleging sexual harassment and assault to her brother with sharp cutting weapon.

In the aforesaid background allegation in the present

Patna High Court CR. MISC. No.16595 of 2019(2) dt.15-03-2019 2/2 FIR is that the petitioners and others assaulted to the informant bitterly and they also fired from their pistol. Petitioners have got no criminal antecedent.

Considering the background and nature of allegation, which is general in nature, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Special Case No.10978 of 2018, arising out of Digha Police Station Case No.581 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
