The petitioner, a retired military personnel has been made an accused in this case along with the driver of a vehicle bearing Registration No.BR-06GB-4014 on account of recovery of altogether 782.640 litres of foreign wine (Indian origin). There happens to be specific disclosure in the FIR that the driver seeing the police stopped the vehicle and ran away. So, there happens to be complete absence of others without specific allegation of connivance.

The petitioner has got clean antecedent as per para 3 of the petition.

Consequent thereupon, petitioner Sitaram Singh in the event of his arrest or surrender within four weeks from today is directed to be released on bail on furnishing bail bonds of

Patna High Court CR. MISC. No.13637 of 2020(2) dt.11-06-2020 2/2 Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the leaned Special Judge, Excise Act, Muzaffarpur in connection with Hathauri P.S. Case No.06 of 2020; subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
